These Terms & Conditions explain the terms under which you use the Bay Scholars website and interact with our services. By accessing our website or contacting us, you agree to these terms.

Last Updated: September 2026

These Terms & Conditions govern your use of the Bay Scholars website and, where applicable, your engagement with Bay Scholars for education guidance, counselling, application support or related services.

By using this website, submitting an enquiry, requesting guidance or engaging Bay Scholars for a service, you agree to these Terms & Conditions to the extent applicable to your use of the website or services.

If you do not agree with these terms, please do not use the website or engage our services.

1. About Bay Scholars

Bay Scholars is a Bangladesh-based international education consultancy providing career-first education guidance to students and families.

Our approach is based on helping students consider:

Career → Subject → University → Country → Budget

before making major education decisions.

Bay Scholars may provide information, guidance, counselling and support relating to career direction, academic subjects, universities, countries, scholarships, budgeting, applications and related education decisions.

2. Nature of Our Services

Bay Scholars provides education guidance and related support.

Depending on the service, this may include:

  • Career and education pathway discussions
  • Subject and programme exploration
  • University research and comparison
  • Country and study-destination information
  • Budget and affordability discussions
  • Scholarship information
  • Application planning and support
  • Document preparation guidance
  • Communication support relating to education applications
  • General international education guidance

The exact scope of any paid service should be communicated separately through a service agreement, quotation, invoice, written confirmation or other appropriate document.

Bay Scholars does not represent that every service listed on this website is included in every engagement.

3. Career-First Guidance

Bay Scholars aims to help students make education decisions based on suitability rather than simply promoting destinations or institutions.

Factors considered may include:

  • Interests
  • Academic background
  • Career direction
  • Subject suitability
  • University fit
  • Financial circumstances
  • Personal preferences
  • Study timeline
  • Available education pathways

The final decision regarding any career, subject, university, country, application or other education choice remains with the student and, where relevant, their family.

4. No Guarantee of Outcomes

Bay Scholars does not guarantee:

  • Admission to any university or institution
  • Acceptance into any programme
  • A scholarship or financial award
  • Visa approval
  • Immigration permission
  • Post-study work rights
  • Employment
  • Salary or career outcomes
  • Professional registration
  • Permanent residency
  • Any particular academic or professional result

Admissions, scholarships, visas and similar decisions are made by independent universities, government authorities, scholarship organisations or other relevant bodies.

Bay Scholars cannot control those decisions.

Any examples, guidance or discussions regarding possible outcomes should not be interpreted as guarantees.

5. Accuracy and Changing Information

Bay Scholars aims to provide useful and reasonably accurate information.

However, international education information can change frequently.

This may include:

  • Tuition fees
  • Entry requirements
  • Application deadlines
  • Scholarships
  • Visa requirements
  • Immigration rules
  • Work rights
  • University policies
  • Programme availability
  • Government regulations
  • Accommodation costs
  • Living expenses

Students should verify important and time-sensitive information using official sources before making significant decisions.

Where appropriate, Bay Scholars may direct students to universities, government authorities, scholarship organisations or other official sources.

Information published on this website should not be treated as legal, immigration, financial or professional advice.

6. Student Responsibilities

Students are responsible for providing complete, truthful and accurate information when working with Bay Scholars.

This includes information relating to:

  • Academic history
  • Qualifications
  • Grades
  • English-language test results
  • Previous applications
  • Visa history
  • Financial circumstances
  • Personal details
  • Supporting documents
  • Any other information relevant to an application or service

Students must not provide false, misleading, altered or fraudulent documents or information.

Bay Scholars may decline, suspend or discontinue services if there are reasonable concerns about false information, document authenticity, misrepresentation or unlawful activity.

Students remain responsible for reviewing information submitted in their name before submission wherever reasonably possible.

7. Student Documents and Accounts

Bay Scholars supports student ownership and transparency.

Our principle is:

Your documents. Your accounts. Your decisions. Your future.

Students should retain access to their important documents, application accounts and official communications.

Where Bay Scholars assists with an application or online process, students should remain informed about what is being submitted on their behalf.

Students are responsible for keeping passwords, verification codes and account credentials secure.

Bay Scholars should not be treated as the permanent owner of a student’s university, application, email or other personal account.

8. Applications and Deadlines

Where Bay Scholars provides application support, students are responsible for supplying required information and documents within the requested timeframe.

Delays caused by incomplete documents, late responses, inaccurate information, third-party systems or circumstances outside Bay Scholars’ reasonable control may affect an application.

Bay Scholars cannot guarantee that an application will be completed or submitted before a deadline if the student does not provide the required information or documents in sufficient time.

Universities and other organisations may also change, extend or close application deadlines without notice.

9. Fees and Payments

Bay Scholars may charge fees for certain counselling, advisory, application or related services.

Where a fee applies, the student or client should be informed of relevant details before agreeing to proceed, including where applicable:

  • Scope of service
  • Fee amount
  • Payment schedule
  • Included services
  • Excluded services
  • Cancellation terms
  • Refund conditions

Specific commercial terms may be provided through a quotation, invoice, service agreement, payment request or written communication.

Unless otherwise agreed in writing, payment for one service does not automatically entitle a student to additional or unrelated services.

Third-party costs such as university application fees, test fees, visa fees, document certification, courier fees, translation fees, travel costs, insurance or similar expenses may be separate from Bay Scholars’ own service fees.

10. Refunds and Cancellation

Refund eligibility depends on:

  • The service purchased
  • The stage of work completed
  • Resources already committed
  • Third-party costs already incurred
  • Any specific written terms agreed before payment

Fees relating to work already completed may not be refundable, subject to applicable law and any specific agreement.

Third-party charges paid to universities, government bodies, testing organisations, payment processors or other external organisations are governed by those organisations’ own refund policies and may be non-refundable.

Where specific refund or cancellation terms have been agreed in writing for a service, those terms will apply to that service.

11. University and Institutional Commissions

Bay Scholars may receive commissions, referral payments or other remuneration from certain universities, education institutions or authorised partners.

Such arrangements are common within international student recruitment and may arise when a student enrols with or completes another qualifying action involving a participating institution.

The existence or amount of a commission should not determine whether an education option is suitable for a student.

Bay Scholars aims to consider factors such as:

  • Student interests
  • Academic profile
  • Career direction
  • Subject suitability
  • University fit
  • Budget
  • Personal circumstances

Not every university or institution discussed or recommended by Bay Scholars will necessarily have a commercial relationship with Bay Scholars.

A commercial relationship does not guarantee:

  • Admission
  • Scholarship
  • Visa approval
  • Enrolment
  • Employment
  • Any other student outcome

Students may ask Bay Scholars whether a commercial relationship exists with a particular institution being discussed.

12. Scholarships and Financial Information

Scholarship information provided by Bay Scholars is for guidance purposes.

Scholarship availability, eligibility, funding amounts, application procedures and deadlines may change.

Bay Scholars does not guarantee that a student will receive a scholarship.

Students should verify scholarship information with the relevant university, government, foundation or scholarship organisation before relying on it.

Budget discussions, cost estimates and affordability information are educational guidance only and should not be treated as professional financial advice.

Exchange rates, tuition costs and living expenses may change.

13. Visa and Immigration Information

Bay Scholars may provide general information relating to student visa processes or direct students to official sources where this forms part of the education journey.

Unless expressly authorised and legally permitted to do so, Bay Scholars does not provide legal or immigration advice.

Visa decisions are made by the relevant government or immigration authority.

Bay Scholars cannot guarantee a visa outcome and is not responsible for decisions made by immigration authorities.

Students are responsible for ensuring that information and documents submitted in connection with a visa process are complete, truthful and accurate.

14. Third-Party Services and Websites

The Bay Scholars website may contain links to third-party websites and services, including:

  • Universities
  • Government authorities
  • Scholarship organisations
  • Professional bodies
  • Testing providers
  • Education resources
  • Payment or communication services

These organisations operate independently from Bay Scholars.

Bay Scholars is not responsible for:

  • Their website content
  • Availability
  • Privacy practices
  • Security
  • Policies
  • Fees
  • Decisions
  • Services

Use of third-party services is subject to the relevant provider’s own terms and policies.

15. Website Use

You may use the Bay Scholars website for lawful personal and informational purposes.

You must not:

  • Attempt to gain unauthorised access to the website or its systems
  • Interfere with website security or operation
  • Upload malicious software
  • Use automated systems to abuse website forms or services
  • Submit fraudulent or intentionally misleading information
  • Use website content unlawfully
  • Impersonate another person
  • Use the website in a way that violates applicable law

Bay Scholars may restrict access where necessary to protect the website, users or business operations.

16. Intellectual Property

Unless otherwise stated, the content created for the Bay Scholars website, including text, branding, graphics, page structures and original educational content, belongs to Bay Scholars or is used with appropriate permission.

You may view and use website content for personal, non-commercial educational purposes.

You may not reproduce, republish, sell, commercially distribute or substantially copy Bay Scholars content without prior permission, except where permitted by law.

Third-party names, logos, trademarks and content remain the property of their respective owners.

References to universities, organisations or other entities do not automatically imply endorsement, partnership or affiliation.

17. No Unauthorised Representation of Partnerships

The presence of a university, organisation, country, scholarship or other third-party name on the Bay Scholars website does not by itself mean that Bay Scholars is officially partnered with, endorsed by or authorised by that organisation.

Where Bay Scholars has a genuine commercial or institutional relationship, this may be communicated separately where appropriate.

Bay Scholars will not intentionally represent a partnership, accreditation or affiliation that does not exist.

18. Limitation of Liability

To the extent permitted by applicable law, Bay Scholars is not responsible for loss or damage arising solely from:

  • Decisions made by universities or institutions
  • Visa or immigration decisions
  • Scholarship decisions
  • Changes in government policy
  • Changes in university requirements
  • Third-party websites or systems
  • Exchange-rate movements
  • Changes in tuition or living costs
  • Delays or failures caused by information not provided on time
  • False or inaccurate information supplied by a student
  • Events reasonably outside Bay Scholars’ control

Nothing in these Terms is intended to exclude or limit liability where doing so would be unlawful.

19. Privacy

Personal information provided through the website or during services is handled in accordance with the Bay Scholars Privacy Policy.

The Privacy Policy is available at:

/privacy-policy/

Students and website users are encouraged to review it.

20. Suspension or Refusal of Service

Bay Scholars may refuse, suspend or discontinue a service where reasonably necessary, including where:

  • False or fraudulent information is provided
  • Documents appear to have been falsified or altered
  • Payment obligations are not met
  • Staff are subjected to abusive, threatening or unlawful behaviour
  • Continued service would create legal, ethical or professional concerns
  • The requested activity falls outside Bay Scholars’ services or capabilities

Where appropriate, Bay Scholars will aim to communicate the reason for discontinuing a service.

Any financial consequences will be considered in accordance with the applicable service and refund terms.

21. Changes to Services and These Terms

Bay Scholars may update its website, services or these Terms & Conditions as the business develops or legal and operational requirements change.

The latest version will be published on this page with an updated Last Updated date.

Changes do not automatically alter separately agreed contractual terms for services already purchased unless the relevant agreement permits such changes or the parties agree otherwise.

22. Governing Law

These Terms & Conditions are governed by the applicable laws of Bangladesh.

Any dispute relating to these Terms, the website or Bay Scholars services should first be raised directly with Bay Scholars so that the parties can attempt to resolve the matter reasonably.

Where a dispute cannot be resolved informally, it may be dealt with through the appropriate courts or legal processes in Bangladesh, subject to applicable law.
